In this document, we would like to inform you about how we process your data, the purposes of the processing, the lawfulness of processing, the storage period, and your rights in processing personal data. The processing of personal data is carried out by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons about the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”).

We operate an e-shop on the website https://www.hardwario.store (the “E-shop” or “Website”), which may process your data when you use it to purchase goods from us, contact us, or otherwise act and communicate with us (“you”).

1. SCOPE OF PERSONAL DATA

    We have divided the personal data we process into categories below:

    • Identification data, such as first name, last name, or username. Personal data is required to order our product, ensure registration, and provide identification for communication (see purposes below). If you are ordering goods on behalf of a company, we also process the company's ID number and VAT number.
    • Contact details such as address, telephone number, and email address are required for communication with you. This information may also include your billing data.
    • User account data, such as user account identification, date of registration, and password, is information stored as part of the user account's use.
    • Purchase and fulfillment data include order number, order time, payment method, invoices, order value, payment information, the information you provide to the vendor, the information needed to process complaints, and other claims or withdrawals from the contract.
    • Delivery details such as delivery address.
    • Communication data, i.e., information about your communication, such as emails, chats, etc.
    • E-shop usage data, i.e., information about your use of our site and your behavior on the E-shop, such as IP addresses and HTTP logs of site usage obtained via your device used to access the E-shop, information about your retained incomplete purchases on the E-shop, etc.
    • Cookie data, i.e., data obtained from cookies and similar technologies we use. For more information about their use, please read the detailed settings of the cookie bar, where you will also find information about the cookies used.

    2. PURPOSES OF PROCESSING PERSONAL DATA

      Your data is processed for the processing purposes described below. For each processing purpose, you will find the scope of the personal data processed and the storage period of the personal data.

      2.1 Performance of the Mutual Contractual Relationship

      We primarily process personal data to fulfill the mutual contractual obligations between you and us based on the contract that has arisen when the contract is concluded according to the terms and conditions or when the contract is concluded on our E-shop. For this purpose, we will also send you emails about fulfilling the mutual contractual relationship, i.e., whether the order is ready for collection, information about invoices, etc.

      For this purpose, we process your identification data, contact data, user account data, purchase data, fulfillment of the mutual relationship, delivery data, communication data, and e-shop usage data.

      We may also share your data with our partners, who will assist us in processing your payments for the products and services you have ordered.

      The legal basis for this processing is the performance of a contract between you and us and the need to take steps at your request before agreeing or where you are not directly party to that contract (for example, if you are an employee of a customer within a wholesale business), our legitimate interest in the performance of any contract entered into.

      The data is processed for the duration of the contract entered into and for the time necessary to perform the obligations under such agreement. The processing period may change in cases where claims or other claims are resolved from the order.

      2.2 User account

      Whether you register a user account on the E-shop or create one when you complete an order for a previous purpose, we will process your data to create a user account, enable its management, and ensure its functionality. Also, within this purpose, you may receive email messages from us related to your user account.

      For this purpose, we process your Identification, Contact, User Account, and E-shop Usage Data.

      The legal basis for this processing is the performance of the contract between you and us, which arises from the registration itself and the acceptance of the terms of use of this user account.

      The data is processed for the duration of the user account, and you can cancel it by contacting us at ask@hardwario.com. Deleting a user account does not delete the Purchase Data and the performance of the reciprocal relationship resulting from individual orders, as processing this information is necessary for other purposes.

      2.3 Contact forms

      There is also a contact form on the E-shop through which you can contact us, for example, if you need help with your selection or have any questions.

      In this case, we will process your Identification Data, Contact Data, Communication Data, and other data you may provide in the contact form (e.g., User Account Data and Purchase and Performance Data). 

      The legal basis for this processing is our legitimate interest in ensuring we communicate with you and deal with your inquiries. 

      The personal data will be processed for the time necessary to process your inquiry. 

      2.4 Internal records, statistics, and protection of our rights

      We may process your data to keep internal records, record payments, produce statistical reports, protect our rights and legal claims, and ensure that we can defend ourselves against any claims you may have.

      For this purpose, we process your Identification Data, Contact Data, Purchase and Mutual Performance Data, Delivery Data, User Account Data, Communication Data, and E-shop Usage Data.

      The legal basis for this processing is our legitimate interest in keeping internal records statistics and protecting our rights. The data is processed for the duration of the limitation periods, usually 10 years from the occurrence of any events from which the limitation period is calculated.

      2.5 Compliance with legal obligations

      We may also process your data to comply with our legal obligations, particularly in tax and accounting. We must invoice each order, keep our books, pay taxes, etc. At the same time, we must be prepared to assist state authorities if the law requires, for example, in connection with fulfilling our obligations under the Consumer Protection Act.

      For this purpose, we process your identification data, contact data, purchase data, and performance of the mutual relationship, as well as delivery data, user account data, communication data, and e-shop usage data, to the extent specific legislation requires.

      The legal basis for this processing is the fulfillment of our legal obligations. The data is processed for the period required by law. For example, this period is up to 10 years in accounting and taxation, considering possible controls.

      2.6 Sending commercial communications

      We may also use your data to send you offers of our services and other commercial communications.

      For this purpose, we process your Identification Data (if known), Contact Data, Purchase Data, and the performance of the reciprocal relationship (if you are a customer).

      The legal basis for this processing is:

      • Our legitimate interest is direct marketing, provided you are our customer and have not opted out of commercial communications.
      • Your consent is provided that you subscribe to our newsletter via the E-shop. We will process your data as long as you do not refuse to send us commercial communications, which you can do in each email.

      2.7 E-shop operation and security (necessity)

      We process your data to ensure the operation and security of the E-shop. Thus, processing your personal data also ensures that the E-shop works as you expect, that everything is displayed correctly, and that it is safe to browse.

      For this purpose, we process your E-shop usage data and cookie data. The legal basis for this processing is our legitimate interest in our E-shop's proper functioning and safe operation. The data is processed as a rule for the duration of your visit to the website, at most for 1 year from the date of collection. Personal data related to cookies are processed until your consent is withdrawn but for no longer than the period specified for the individual cookies stored by the E-shop.

      2.8 Analysis of E-shop traffic (analytics)

      We process your data to understand how visitors use our E-shop. For this purpose, we can monitor E-shop traffic, optimize the E-shop, and generally make the E-shop visit more user-friendly.

      With your consent, we may process cookie data for this purpose, which facilitates us in making more detailed analyses of visits to the E-shop (analytical cookies), whereby your data may also be passed on to third parties. The legal basis for processing here is thus your consent given via the cookie bar. Personal data related to cookies are processed until your consent is withdrawn. Still, for no longer than the period specified for each cookie stored on the E-shop, details of the storage period are given in the cookie bar.

      2.9 Support and promotion of the E-shop (marketing)

      We process your data to obtain information about your preferences and display relevant advertising. In doing so, we may promote and offer products and services in the e-shop, show you marketing communications relating to the products and services you have enquired about, and promote our brand online.

      With your consent, we may process Cookie Data for this purpose, which makes it easier for us to get to know you better and to target better advertisements (marketing cookies), whereby your data may also be passed on to third parties. The legal basis for processing here is thus your consent given via the cookie bar. The personal data related to cookies is processed until your consent is withdrawn. Still, in any case, the cookie bar provides details of the storage period for no longer than the period specified for the individual cookies stored on the E-shop.

      3. SHARING OF PERSONAL DATA

        Your data may be shared with the following recipients:

        • shipping companies that arrange the transport of goods and companies that arrange the delivery of goods;
        • the company that handles online payments (in which case, however, this company is a separate data controller);
        • the company that provides the operation of the E-shop and other services in connection with the operation of the E-shop – in particular WooCommerce Ireland Ltd. and related companies that operate the website and web platform on which the E-shop is hosted;
        • the providers of add-ons within the platform on which the E-Shop is hosted;
        • the providers of the system that delivers emails and commercial communications – Hubspot, Inc. manages customer relations and marketing on the E-Shop;
        • CRM system providers;
        • providers of the accounting system;
        • external accountants;
        • cloud storage and infrastructure providers;
        • government authorities that provide administration in the field of taxation and accounting control, or other authorities that ask us to transfer personal data in the context of the purpose of „Fulfilling legal obligations” if we are obliged to do so based on the relevant legislation (in particular, administrative authorities, police authorities, the Czech Trade Inspection Authority and judicial authorities). 

        We share your data with controllers and processors in third countries (outside the EEA), but we only do so where these parties comply with the sufficient safeguards under Article 44 et seq. of the GDPR.

        4. YOUR RIGHTS IN PROCESSING AND THE POSSIBILITY OF EXERCISING THEM

          You have the right to (i) request access to your data, (ii) withdraw your consent, (iii) request the rectification of your data, (iv) request the erasure of your data, (v) request the restriction of the processing of your data; (vi) request the portability of your data; (vii) object to the processing of your data; or (iii) lodge a complaint with the relevant supervisory authority.

          For all issues related to the processing of your personal data, whether you have a question, want to exercise your rights, or want to send a complaint, you can contact us via the email provided at the beginning of this document.

          4.1 Right of access

          You have the right to obtain confirmation from us as to whether or not we are processing your data. If we process your data, you also have the right to request access to information about the purpose and scope of the processing, the recipients of the data, the duration of the processing, the right to rectification, erasure, restriction of processing, and object to processing, the right to complain with a supervisory authority, and the sources of the personal data (this information is already provided in this document).

          You can also ask us for a copy of the personal data we process. We provide the first copy free of charge; others may already be subject to a fee. The scope of the data provided may be limited so as not to interfere with the rights and freedoms of others.

          4.2 Right to withdraw consent.

          You can withdraw your consent to processing personal data at any time. However, the withdrawal of consent does not affect the lawfulness of the processing before such consent, nor does it lead to the termination of the processing of personal data that has already been anonymized.

          4.3 Right to rectification

          You have the right to request that we correct inaccurate personal data concerning you. Depending on the purpose of the processing, you may also have the right to have incomplete personal data completed, including by providing an additional declaration.

          4.4 Right to erasure (right to be forgotten)

          You have the right to request the erasure of your data where:

          • We no longer need your data for the purposes for which it was collected or processed;
          • You withdraw the consent based on which the personal data was processed, and there is no further reason for processing it:
          • You object to processing, and there are no other overriding reasons for processing. you object to processing for direct marketing purposes;
          • personal data are processed in breach of the law. However, you cannot exercise this right if the processing is necessary to comply with our legal obligations, perform tasks entrusted to us in the public interest, or establish, exercise, or defend legal claims.

          4.5 Right to restriction of processing

          You have the right to request the restriction of the processing of your data where:

          • You contest the accuracy of your data; in this case, you may request the restriction of processing until the accuracy of the personal data has been verified;
          • the processing is in breach of the law, and you request restriction of the processing of your data instead of erasure;
          • We no longer need your data for the purposes for which it was collected or processed, but you require it for the establishment, exercise, or defense of legal claims;
          • you have objected to processing your data; in this case, you may request a restriction of processing pending verification that our legitimate interests prevail.

          4.6 Right to Portability

          You have the right to obtain a copy of your data that we process by automated means based on your consent or for the performance of a contract. If technically feasible, we will transmit this data to you or a controller you designated in a commonly used and machine-readable format. The scope of the data provided may be limited so as not to interfere with the rights and freedoms of others.

          4.7 Right to object

          You have the right to object to processing your data, which we process based on our legitimate interest. We will stop processing your data if there are no other overriding reasons for the processing, if the processing is not necessary for the establishment, exercise, or defense of legal claims, or if you object to processing for direct marketing purposes.

          5. RIGHT TO LODGE A COMPLAINT

            You can exercise your rights with our company and file a complaint with the relevant supervisory authority, the Office for Personal Data Protection, located at Pplk. Sochora 27, 170 00 Prague 7.

            6. CHANGES TO THIS PROCESSING INFORMATION

              We are entitled to change this processing information occasionally, so please check it regularly. We will post any changes to this document on our E-shop.
